A Former Zimbabwe Revenue Authority(Zimra) regional Manager’s appeal for reinstatement hit a brick wall after a Bulawayo Labour Court Judge dismissed the application.
Patrice Selamolela was dismissed after he was found in possession of xxx material in 2011 on his computer. He however denied possession of the material arguing that any one could access his machine.
Moyo Matshanga, a Labour Courtjudge, however dismissed his application for reinstatement with benefits. “After digital forensic investigation, the system generated information that revealed that Selamolela was the one who sent all the xxx material. An analysis of the ownership and origins showed his sending credentials.
“A folder named DITABA was found on the desktop and it contained xxx material and the analysis done showed his credentials. An xxx video was also found on Selamolela’s laptop and hard drive. I therefore find that the xxx material was sent from Selamolela’s desktop and laptop which belonged to Zimra and such material had been sent by Selamolela.
“This in my view, has been proved on a balance of probabilities. In the circumstances, the appeal is dismissed with costs,” the judge said.
Selamolela had been employed as the regional Manager at the Bulawayo Port Office. Sometime in 2011, the IT department at the Zimra Bulawayo Branch realised that their server was clogged and then launched investigations.
Technical experts checked to see if the material clogging the system was necessary and whether it should be retained. In doing so, they discovered that some of their employees were sending xxx material from the desktops that Zimra had allocated to them.
Selamolela was one of the employees found wanting. On June 30, 2011, he was suspended and subsequently fired after being arraigned before a disciplinary committee.
He appealed internally to no success and then he approached the Labour Court.
